SMS Terms & Mobile Information Policy

1. Program Description
The Shockwave SMS program (the "Program") sends transactional and occasional promotional text messages to people who have opted in at consent.shockwavehq.com or via other written opt-in mechanisms operated by Shockwave ("we," "us").
Message types include: demo booking confirmations, appointment reminders, service status updates, and occasional product updates. We send up to 6 messages per month.
2. How You Opt In
You opt in by checking the SMS consent box on consent.shockwavehq.com and confirming the phone number you submitted is yours. After you submit the form, we will text you a one-time confirmation message asking you to reply YES. You become a fully enrolled subscriber once we receive that YES reply (double opt-in).
Consent is not required as a condition of purchase or to receive a demo.
3. How You Opt Out
You can opt out at any time by replying STOP, QUIT, UNSUBSCRIBE, END, or CANCEL to any Shockwave SMS message. We will send a single confirmation that you have been unsubscribed.
Per the FCC TCPA Opt-Out Rule effective April 11, 2025, we honor opt-out requests within ten (10) business days across our systems and any affiliated channels you have opted into. Replying STOP to a transactional message ends marketing only; reply STOPALL to end transactional service messages as well.

4. Message & Data Rates
Message and data rates may apply per your wireless carrier's plan. Message frequency varies. Shockwave is not responsible for charges imposed by your carrier.
5. Supported Carriers
The Program is available on most major US wireless carriers, including AT&T, T-Mobile, Verizon Wireless, Sprint, Boost, Cricket, MetroPCS, U.S. Cellular, Virgin Mobile, and others. Carriers are not liable for delayed or undelivered messages.
6. Mobile Information & Third-Party Sharing
We will not share, sell, rent, or otherwise distribute your mobile phone number, SMS consent, or any other mobile information with third parties or affiliates for marketing or promotional purposes.
We share mobile information only with the service providers we use to operate the Program (for example, Twilio for message delivery and our internal automation infrastructure), and only to the extent necessary to deliver the messages you have opted in to receive. These providers are contractually bound to keep your information confidential and to use it solely for the purpose of delivering Program messages.
We may disclose information when required by law, valid legal process, or to protect our rights.
7. Data Retention
We retain SMS consent records and message logs for a minimum of five (5) years to comply with the federal Telephone Consumer Protection Act (TCPA) four-year statute of limitations and the FTC Telemarketing Sales Rule five-year retention requirement. Operational message content may be retained longer to support audit, dispute resolution, and security.
8. Eligibility
You must be at least 18 years of age and the account holder or authorized user of the mobile phone number you submit. By opting in, you represent that this is true.
9. Changes to These Terms
We may update these SMS Terms. Material changes will be communicated by text message to active subscribers or by posting the updated terms here with a new effective date. Continued use of the Program after a change constitutes acceptance of the updated terms.
